The Federal Department of Transportation (DOT) regulations require an evaluation by a Substance Abuse Professional (SAP) before an employee can return to a safety-sensitive job when the employee has tested positive for drugs and/or alcohol. The evaluation is a requirement to determine the nature and extent of the person’s alcohol and/or substance use and to help get treatment and/or education.

Rule 49 CFR-40 describes the required procedures for conducting workplace drug and alcohol testing for the federally regulated transportation industry. DOT regulations state all employers must provide their employees with contact information for a qualified SAP.
